In a press release published this Friday, the Senegalese National Lottery (LONASE) welcomes recent judicial and regulatory decisions that strengthen its position in the dispute with AFITECH. During its hearing on September 11, 2025, the Supreme Court ruled that it lacked jurisdiction to hear the administrative summary proceedings seeking the suspension of the LONASE/PAYMETRUST contract, filed by AFITECH, thereby confirming that LONASE had not exceeded its contractual prerogatives.

Furthermore, the Public Procurement Regulatory Authority (ARCOP) issued two key decisions. On July 1, 2025, it declared inadmissible AFITECH's appeal challenging the commissioning of a second centralization platform, considering that this dispute falls outside the scope of public procurement.

In its second decision of September 1, 2025, ARCOP qualified the violation of the judge's exclusive jurisdiction clause, while classifying the LONASE/AFITECH agreements as a public service delegation and LONASE/PAYMETRUST as a public-private partnership (PPP). To ensure the continuity of public service, it recommended the launch, within six months, of a new procedure in accordance with PPP rules.

LONASE, strengthened by these arbitrations, reaffirms its commitment to defending Senegal's interests by challenging the injurious contracts. It undertakes to adapt the contracts with AFITECH and PAYMETRUST to the requirements of the PPPs within the given timeframe, thus guaranteeing transparency and continuity, as suggested by ARCOP, which does not exclude the possibility of LONASE maintaining several platforms.
