Meurtre de sa première épouse enceinte : Un Sénégalais et sa deuxième femme condamnés en France
A man was sentenced to life imprisonment on Thursday for the murder of his eight-months-pregnant wife in August 2022 in Montargis (Loiret), while a ten-year prison sentence was handed down to his second partner.
Sileye Ba, 38, of Senegalese nationality, appeared before the Loiret Assize Court since Monday with his second partner Dieynaba Kande, also Senegalese and aged 34, for aggravated murder and habitual violence.
He was found guilty of having inflicted the "most serious blows" with "an intention to kill" Clothilde G., 31 years old and eight months pregnant, on the night of August 2 to 3, 2022. He was sentenced to life imprisonment with a security period of twenty years and the withdrawal of his parental authority.
His second partner was found guilty of habitual violence between January and August 2022, without having "participated in the victim's death." She was sentenced to ten years in prison, with a two-thirds security term.
"My daughter will not be resurrected, nor will the baby, but it is a fair decision," reacted the victim's father, Didier Ghiti.
In his submissions, Attorney General Pierre-Henri Cassitti had requested life imprisonment for the two accused, with a minimum sentence of twenty years.
"I see nothing but liars," the attorney general declared. "We don't know who struck the fatal blows, but both defendants struck with the same intensity and violence that caused death."
During the proceedings, they both blamed each other for the fatal blows.
Sileye Ba first repeatedly mentioned Dieynaba Kande's habitual violence towards the victim, against a backdrop of jealousy and deception, after having stated that his only crime had been "living under the same roof with two women".
Ms. Kandé also said she was a victim of violence, describing the influence of a jealous, angry, drug-using, and regularly violent husband.
The victim, married to the accused, died in hospital, as did the near-term baby she was carrying.
According to the autopsy carried out on the victim's body, the cause of death was "severe head trauma," while some of the injuries "are consistent with acts of torture and barbarity. The numerous injuries are of different ages (...) and were observed all over the body."
In their hesitant justifications, however, the two accused failed to explain a cut on the ear or vaginal injuries, nor did Mr. Ba justify the account of the evening told to the police by one of his daughters or the mark of his signet ring on the victim.
The attorney general considered that the blows were inflicted on "vital areas, such as the skull" and that "the strangulation carried out" was done with the deliberate aim of strangulation.
At the hearing, which appeared to depict a love triangle under influence, Sileye Ba said he had met the victim a few years earlier in Senegal, before marrying her and moving to France with her. He then allegedly managed to convert the victim to Bayefallism, a marginal branch of Islam, particularly in Senegal, setting himself up as the two women's "spiritual guide."
The couple's three children, aged 2, 3 and 5, and the second partner's three-year-old, who was quickly placed with child welfare services, were noticeably dirty.
Sileye Ba's lawyer, Christiane Aminata Diop, announced that her client would appeal the decision, "convinced of the co-accused's guilt."
Ms. Kande's representatives, for their part, welcomed to AFP "a balanced and fair decision, commensurate with the debates."

Cette femme qu'il a tuée lui a permis d'avoir d'aller en France et d'avoir des papiers. La condamnation à perpétuité est méritée.
