Notto Diobass : Le berger A. Bâ assène deux coups de machette au cultivateur M. Sarr et prend 3 mois de prison ferme
It would have been considered murder if the machete blows from shepherd A. Bâ had struck vital parts of farmer M. Sarr's body. He inflicted two blows with the machete on his right arm and left calf.
The farmer had initially found A. Bâ's herd of cattle devastating his hibiscus (bissap) field. When he tried to take the animals to the village chief to be impounded, the herder surprised him from behind with a machete. He struck him twice before disappearing with his herd.
Seriously injured, the farmer went to the hospital for treatment. Armed with a medical certificate attesting to a 30-day period of incapacity for work, Mr. Sarr filed a complaint with the gendarmerie against A. Bâ for assault and battery.
Arrested and charged, the accused was remanded in custody. Appearing before the court for flagrant offenses on Friday, December 5th, the defendant denied the accusations. He stated that Mr. Sarr attacked him first with a stick, and that when he tried to retaliate with his machete, Mr. Sarr blocked it and injured himself.
The plaintiff reiterated that the shepherd surprised him and struck him twice with a machete. He is claiming 500,000 FCFA in damages.
Considering the facts to be consistent, the public prosecutor requested the application of the law.
The judge found A. Bâ guilty of assault and battery. He sentenced him to three months in prison and ordered him to pay the plaintiff 300,000 FCFA in damages.

Le procureur a pris parti en utilisant la Constance pour un incriminé un bergé qui s’est défendu face à un cultivateur ki a voulu se faire Loi lui même en essayant de confisquer les bien du berger Au lieu de saisir la justice le cultivateur à voulu se faire justice.Mais bon puisque k nous Sommes dans un pays qui favorise une langue,une ethnie alors ces dérives juridiques deviennent une norme.Des procureurs qui prennent parti de maniéres aussi flagrantes deviennent les justifications d’une revolte comme au Burkina,Mali,Nigeria….

Le berger est un menteur ses parents sont des domarames eux qui ont fait des rapports dans un enclos pour le mettre au monde
Le troupeau était dans le champs, alors c'est le berger qui a tort et ensuite le cultivateur a produit un certificat médical ce que le berger n'a pas! 3 mois c'est si faible pour ce délit !!

Moi, je voudrais juste que l'on nous explique les standards de la justice sénégalaise.v Vous tailladez quelqu'un àcoups de machette, on vous inflige 3 mois ferme. Vous volez des oeufs, c'est quatre mois. J'ai l'impression d'avoir perdu la notion de gravité des faits. Rassurez-moi donc.
