Pêche tragique en pleine mer : Les peines que risquent les frères de l’adolescent battu à mort
A tragedy occurred in March 2021 during a fishing expedition between Guinea-Bissau and Sierra Leone. Mouhamed Fall, known as "Ameth," aged 15, died in circumstances which, according to the prosecution, constitute not an accident, but a homicide.
Initially, Habibou Gamou Fall, the pirogue's captain and the victim's half-brother, claimed it was an accidental death. He maintained that young Mouhamed had fallen from the side of the boat before being swept away by the swell. This version was echoed by his brother, Abdoulaye Fall.
But this theory was disputed by several crew members, including Seydina Issa Camara, Adama Dembélé, and Massamba Samb. They asserted that the young boy died as a result of repeated violence.
According to their testimonies, Mouhamed Fall was severely beaten by Habibou Gamou Fall for four consecutive days, under the pretext of punishing him for his supposed laziness. The beatings were allegedly so violent that the teenager was urinating blood before dying. His body was reportedly kept in an icebox before being thrown into the open sea due to its advanced state of decomposition and an engine failure that immobilized the pirogue. The Fall brothers then reportedly asked the crew to declare it an accidental death.
In the dock of the Mbour Criminal Court, Habibou Gamou Fall stated that Mouhamed Fall had fallen ill. After taking ibuprofen, he fell asleep and never woke up. He denies any violence. His brother, Abdoulaye Fall, corroborated this version of events, but the judge and the prosecutor reminded him that he had admitted during the investigation that the victim had been beaten.
The prosecutor denounced Abdoulaye Fall's "inhuman" behavior, accusing him of remaining passive in the face of the violence inflicted on his brother. Considering that the facts demonstrate criminal intent and a clear desire to cover up the crime, the prosecution requested a 20-year prison sentence for Habibou Gamou Fall and a 5-year prison sentence for Abdoulaye Fall.
For the defense, Mr. Abdoulaye Tall dismissed the charges of criminal conspiracy and conspiracy. He argued for a lesser charge of assault and battery resulting in death without intent to kill. He requested leniency in the application of the law and the acquittal of Habibou Gamou Fall.
The case was adjourned for deliberation until January 16, 2026.
