Presenting himself as a businessman active in several sectors, CT Sarr, residing in Keur Thione Sarr, appeared before the Thiès court of flagrant offenses to answer for the offenses of forgery, use of forged documents and fraud relating to the sale of plots of land using falsified documents.

The case originates from several land transactions in the municipality of Mont-Rolland. According to the evidence submitted, the boundary demarcation documents given to the buyers turned out to be falsified. Checks carried out with the town hall revealed that the presented resolutions were not recorded in the official registers of the local authority.

In court, several victims recounted the circumstances in which they were defrauded.

NF Sène stated that she paid 1,400,000 FCFA for the purchase of three plots of land. According to her testimony, the defendant only provided her with scanned copies of the administrative documents. When she demanded the originals, he was unable to produce them and subsequently disappeared. She is now demanding a full refund.

For his part, Mr. Cissé claims to have paid one million FCFA for two plots of land. After checking, he discovered that the plots sold did not belong to the defendant. Faced with the overall loss and related expenses, he is now requesting the return of 1,600,000 FCFA.

A. Cissé explained that he had handed over 650,000 FCFA and several sheep in exchange for about twenty plots of land. He maintains that he received scanned copies of forged administrative documents and is demanding six million FCFA and genuine land titles as compensation for the damages suffered. Three other plaintiffs, identified as S. Coly, M. Touré, and D. Guèye, did not appear at the hearing.

Faced with the accusations, CT Sarr denied any fraudulent intent. He stated that he himself acquired the plots from a certain Ndiaw after verifying the information at the Mont-Rolland town hall. According to him, the documents in his possession were given to him as part of this acquisition before he resold the land to the various plaintiffs. He nevertheless pledged to reimburse all sums received from the buyers.

In his closing argument, the public prosecutor stated that the facts were clearly established. He emphasized that the documents presented in court were falsified and did not correspond to any legally identified property. The prosecutor also reminded the court that the defendant is currently serving a three-month prison sentence for similar offenses.

Considering the seriousness of the facts and the harm caused to the victims, the prosecution requested a guilty verdict for forgery, use of forged documents and fraud, as well as a sentence of two years imprisonment.

The case has been adjourned for deliberation.
