A scandal involving romantic revenge and the distribution of intimate videos was examined by the Mbao court. At the heart of the case, reports L'Observateur, which attended the hearing, a "sextape" was used as a weapon of retaliation by a jilted lover living in Canada, with the alleged complicity of a driver presented as the technical link in this social destruction scheme.
The case began when Ms. Mbaye, a married woman, decided to end her relationship with her former lover, O. Samb, who lived in Canada. Refusing to accept the separation, Samb allegedly tried to break up the plaintiff's marriage by distributing intimate videos she had sent him in the past. To act remotely, he reportedly devised a scheme using a Senegalese SIM card to create a WhatsApp account and flood the victim's in-laws with obscene images.
In this context, AC Ndiaye, a 42-year-old driver and close friend of the two protagonists, found himself in court on charges of complicity. He was accused of having purchased and registered in his name the Free SIM card used to distribute the images. The prosecution argued that the defendant could not have been unaware of the intended purpose and, by providing the technical means, knowingly facilitated the actions of the main perpetrator. For his part, the driver maintained that he was simply doing a favor for a friend, unaware of his malicious intentions. Furthermore, the technical examinations conducted by the gendarmerie on his phones revealed no trace of compromising videos or conversations.
Despite the prosecutor's demands for a six-month prison sentence, arguing that supplying the SIM card constituted irrefutable material complicity, the court ultimately sided with the defense. Finding that criminal intent was not sufficiently established, the judge acquitted AC Ndiaye and dismissed the charges against him. The main perpetrator, meanwhile, remains at large in Senegal, reports the newspaper of the Future Media Group.
