Tribunal de Thiès : M. Kane envoyé en prison pour avoir blessé son présumé agresseur
Mr. Kane, known as "Jakartaman," was sentenced to three months' imprisonment, suspended, by the Thiès court for assault and battery causing 12 days of incapacity for work on his alleged assailant, Mr. Ndiaye. The incident occurred in Thiès.
While going about his business, Mr. Kane was intercepted by three assailants who stole his motorcycle. During the attack, he recognized two of the assailants, including Mr. Ndiaye and N. Fall. He then went to the police station to file a report.
The day after the incident, the victim went to a motorcycle taxi stop in the Medina Fall neighborhood and encountered the suspect, Mr. Ndiaye. When he tried to detain him there to call the police, Mr. Ndiaye's associates attacked him.
That's when Mr. Kane picked up a stone to defend himself. His blow struck the suspect, Mr. Ndiaye, in the head. Injured, Mr. Ndiaye obtained a medical certificate attesting to a 12-day period of incapacity for work and filed a complaint with the police against Mr. Kane for assault and battery. Mr. Kane was arrested.
In court in Thiès on Monday, December 22, Mr. Kane admitted to the facts. "Three individuals attacked me and stole my motorcycle. I recognized Mr. Ndiaye and N. Fall. When I encountered Mr. Ndiaye, I called out to him to call the police. He became enraged, and his companions attacked me. I injured Mr. Ndiaye with a stone."
The public prosecutor considered the facts to be established and requested the application of the law. The judge found Mr. Kane guilty of CBV and sentenced him to three months suspended.
