L'accusé Issouf Kandé, placé en détention provisoire depuis le 3 novembre 2010, a été condamné, vendredi, à 10 ans de travaux forcés par la Cour d'assises de Ziguinchor (Sud) qui l'a déclaré coupable de détention de chanvre indien destiné à la culture, a constaté l'APS.La cour a rejeté l’exception de nullité de la procédure soulevée par la défense, en déclarant que l'action est régulière. Les faits pour lesquels Kandé est renvoyé devant la Cour d'assises remontent au 22 octobre 2010 à Bounkiling, dans la région de Sédhiou.
Des éléments de la brigade de gendarmerie ont été informés de la présence de deux individus suspects aux alentours de la localité. Les deux individus ont été arrêtés puis conduits à la brigade de gendarmerie. Après une fouille minutieuse, ils ont trouvé un fusil de chasse, dans le sac appartenant à Alioune Camara. Dans celui de Issouf Kandé, ils ont découvert 1,750 kg de graines de chanvre indien. Kandé a déclaré aux enquêteurs que le fusil de chasse et les graines appartiennent à Aliou Camara. Ce que ce dernier à nié catégoriquement. Mais devant le juge d'instruction, Kandé, âgé de 31, ans a reconnu que les graines de cannabis lui appartenaient.
Surnommé Drogba, du nom de l'international ivoirien, il a précisé qu'il avait l'intention d'utiliser les graines de chanvre indien pour se faire des rastas. Il a soutenu que le fusil de chasse appartiendrait à Alioune Camara qu'il avait tout juste rencontré à la gare routière de Bounkiling. En outre, il a a affirmé qu'il devait se rendre à Bignona (30 km de Ziguinchor) pour les besoins du championnat populaire de football, appelé Navetanes. Devant la barre de la Cour d'assises, il a reconnu la propriété des graines de cannabis, tout en parlant d'une petite quantité destiné à un usage cosmétique. Alioune Camara était absent à l'audience puisqu'il avait été condamné à 6 mois d'emprisonnement ferme pour détention d'arme de 3éme catégorie sans autorisation administrative.
Il avait alors bénéficié d'une liberté totale,puisqu'il avait purgé 2 ans et 3 mois. D’après l'avocat général, la destination des graines de chanvre indien ne fait l'objet d'aucun doute. ''Vous ne pouvez pas utiliser 1750 grammes de graines de chanvre indien pour se confectionner des rastas. C’est invraisemblable. Les graines sont destinées à la culture'', a lancé Djibril Bâ à l'accusé. Le représentant du ministère public a requis 10 ans de travaux à l'encontre de Issouf Kandé, coupable, selon lui, du délit de culture de chanvre indien. La défense a quant à elle émis des doutes sur le poids et la destination des graines saisies sur son client, tout en déplorant l'absence d'un scellé justifiant la quantité mentionnée dans le procès-verbal établi par les gendarmes. C'est pourquoi Me Martin Diatta a plaidé pour l'acquittement de Issouf Kandé au bénéfice du doute. ASB/AD
