Affaire SOS Keur Yeurmandé : Le procureur de la République s’oppose à la libération de Ndella Madior Diouf
Having been granted provisional release during her trial last Tuesday at the Dakar Criminal Court, Ndella Madior Diouf remains in detention. According to Seneweb, the public prosecutor has appealed.
However, in his indictment, the representative of the public prosecutor's office had requested acquittal for the crimes of human trafficking, deprivation of food and for violations of burial laws.
On the other hand, the prosecutor requested a five-year prison sentence and a fine of one million FCFA for illegally practicing medicine, manslaughter, failure to assist a person in danger, and endangering the lives of others.
For the other defendants, including assistant Cheikh Tidiane Ndiaye, presenter El Hadji Séne, and the nannies, the prosecutor requested three months' imprisonment for failure to assist a person in danger. The Criminal Court will deliver its verdict on May 26.
Several scenarios are now open to Ndella Madior Diouf, who has been in detention since December 20, 2023. In the secrecy of its decision, the court can acquit her, sentence her to a suspended sentence, or to a sentence shorter than the time she has already spent in pretrial detention. This would lead to her release. Conversely, she can be found guilty and sentenced to a term that would keep her in detention.
Unless the prosecution withdraws its appeal, Ndella Madior Diouf will remain in prison, without the possibility of the Court ruling on the appeal. Indeed, the case file cannot be transferred, as it is already in the hands of the judge for deliberation.
