Levée de l’immunité de Farba Ngom : Me Oumar Youm annonce une plainte contre la ministre Yassine Fall
The legal response has begun. Lawyer Oumar Youm announced the imminent filing of a complaint against the Minister of Justice, Yassine Fall, for "serious violations of the rights" of his client, MP Farba Ngom.
Speaking on the sidelines of a press conference this Tuesday, February 11, at the Café de Rome, the lawyer indicated that the complaint will be filed in Senegal and, if there is no follow-up, brought before international courts, particularly in France, for "violation of the right to one's image, invasion of privacy, violation of personal data and of the secrecy of correspondence".
According to Mr. Youm, the minister made "too many mistakes" in the handling of Farba Ngom's case, notably by, he says, investigating an appeal aimed at keeping his client in detention.
"This is an arbitrary detention," he insisted, accusing the judicial authorities of "prematurely imposing the sentence" and undermining the fundamental principle of the presumption of innocence.
The lawyer also denounces a breach of equality before the law, pointing out that for similar acts, a co-defendant Tahirou Sarr has regained his freedom while Farba Ngom remains in prison.
Another point raised concerns the MP's state of health. Lawyer Oumar Youm asserts that two medical reports ordered by the judge conclude that his health is incompatible with detention. Despite this, Farba Ngom has reportedly been held in prison for nearly a year.
The lawyer finally called on the deputies to "exercise restraint" when considering the request to lift the parliamentary immunity of their colleague, believing that this immunity protects the function of representative of the people and cannot be called into question in violation of constitutional rules.
