Suite à l’affaire des présumées homosexuels : L’Etat va durcir les peines
The state is opting for a firm stance. This follows the case of the alleged homosexuals arrested by the Keur Massar Research Brigade. In a cabinet meeting this Wednesday at the Presidential Palace, the government examined and adopted a more repressive text.
Secretary of State to the Prime Minister, in charge of Relations with Institutions, Government Spokesperson, Marie Rose Khady Fatou Faye, informs that this decision concerns the draft law amending Law No. 65-60 of July 21, 1965, concerning the Penal Code: - modification of Article 319 with clarification of the definition of acts against nature, hardening of penalties and integration of the glorification and financing of these types of acts into the sanctions.
Indeed, Article 319 of the Senegalese Penal Code (1965) stipulates that: “Anyone who commits an indecent or unnatural act with an individual of the same sex shall be punished by imprisonment for one to five years and a fine of 100,000 to 1,500,000 FCFA. If the act was committed with a minor under 21 years of age, the maximum penalty shall always be imposed.”
The maximum penalty is 5 years imprisonment, accompanied by a fine of 1,500,000 FCFA. This maximum penalty is systematically imposed when one of the parties is a minor at the time of the events (21 years or younger).
