Following the vote on the law establishing the National Office for the Fight against Fraud and Corruption (OFNAC), work continues in the National Assembly. This time, it is for the examination of the bill relating to the Declaration of Assets. According to the rapporteur of the intercommittee formed by the Committee on Laws, Decentralization, Work and Rights human and the Finance Committee and Budgetary Control, Youngare Dione, in a meeting, the Minister of Justice recalled that the exercise of high public functions is accompanied by a duty of responsibility, probity and integrity, excluding any dynamic of monopolization of public resources. Moreover, He also stated that there are at least two reasons for the proposed amendment to this law.

"The first is linked to the implementation of the new framework for development policies, the National Agenda ''Senegal 2050''. This new framework, which advocates transparency, underpins the desire of the President of the Republic to authorize the publication of reports from all control bodies. Thus, the status and obligations of certain taxable persons have been modified in order to broaden the scope of application of the law, in particular for personnel in charge of the execution of budgets whose financial criterion of subjection increases from one (1) billion to five hundred (500) million CFA francs. This modification aims to better protect public funds," he said.

In addition, the MP stated, individuals holding certain positions that expose them to the risk of corruption must also comply with the asset declaration requirement, in accordance with the law. These include, in particular, heads of courts, tribunals, and prosecutors, as well as the Dean of the investigating judges and the presidents of chambers, members of civil, military, and paramilitary bodies and bodies for control, inspection, verification, audit, investigation, and inquiry, and all directors and heads of departments involved in the mining, quarrying, and hydrocarbons sectors.

The second reason for this bill is that asset declarations must necessarily be an instrument for combating corruption, beyond illicit enrichment. "For example, certain variations in assets may not be indicators of the presumption of illicit enrichment, but may provide information on the illicit nature of certain concealment, front men, or alert people to possible conflicts of interest. Indeed, rigorous identification and updating of the file of those subject to the tax are essential conditions for the effectiveness of this mechanism," reports Youngare Dione.

    Une loi que l'opposition devra attaquer devant le conseil constitutionnel. Diogomaye se gourre en pensant qu'il va échapper à la déclaration de patrimoine en 2029 quand on aura dégagé le pastef !
