The Speaker of the National Assembly, El Malick Ndiaye, addressed President Bassirou Diomaye Faye's decision to request a second reading of the law amending the Electoral Code. This exceptional measure follows the discovery of two divergent versions of the text adopted by the members of parliament on April 28, 2026. Faced with the controversy, El Malick Ndiaye claims it was a "clerical error."
The misunderstanding between the two texts sent to the Presidency
According to the Speaker of the House, the Head of State officially referred the matter to Parliament under Article 73 of the Constitution. In his message, Bassirou Diomaye Faye explained that he had received "two different versions of the draft law" concerning the amendment of Articles 29 and 30 of the Electoral Code.
This confusion, also relayed by some MPs in the press, prompted the President of the Republic to demand a new deliberation to guarantee the legal security of the text before its signing.
"A clerical error" by the legislative services
Attempting to reassure the public, El Malick Ndiaye explained the origin of the problem: "After the vote, the legislative services realized that part of the amendment adopted in committee contained a clerical error." The relevant departments then tried to correct it to produce the final version, thus creating an administrative duplication.
The Speaker of the Assembly claims to have personally spoken with the Head of State to clarify the situation and agree on a new, compliant transmission.
An emergency procedure to unblock the law
El Malick Ndiaye emphasized the legality of this second reading, which requires a three-fifths majority of the members of parliament. This referral automatically suspends the promulgation deadline.
To prevent the process from stalling, the emergency procedure has been activated: the review period has been reduced from eight to four days. El Malick Ndiaye assures that the law will be promulgated "within the same week."
Although the president of the National Assembly is trying to downplay the incident, this "double version" affair raises serious questions about the rigor of the legislative validation chain in Senegal and risks offering a prime platform to the opposition.
