Code électoral : polémique sur la légalité de la procédure d'urgence
President Bassirou Diomaye Faye has sent the draft bill amending the Electoral Code back to the National Assembly for a second reading, after receiving two different versions of the text. Members of Parliament are summoned for the debate this Saturday. However, the method used by Parliament to handle this matter has sparked considerable controversy.
A procedure deemed illegal
To examine this text in plenary session, the National Assembly resorted to the emergency procedure. This move has been strongly denounced as a "total violation of procedure" by former MP Théodore Monteil. Interviewed by L'Observateur, Monteil points out that an emergency can only be declared by the President of the Republic or by the Assembly itself. In the latter case, it must be requested by "one-tenth of the MPs" and be formally voted on in plenary session.
The interlocutor of the Future Media Group argues that in the absence of this vote, Parliament is committing a "serious error," as no decision of such importance can be validated without the explicit approval of parliamentarians.
This haste is also criticized by former MP Cheikh Oumar Sy, who speaks of an "irresponsible attitude" on the part of the institution. Quoted by the same source, he expresses astonishment that a text referred on Friday is processed under emergency procedures over the weekend, in less than twenty-four hours, while numerous other "urgent matters facing the Senegalese people" deserve, in his opinion, more sustained attention.
