The opposition parliamentary group Takku Wallu Sénégal announced last Tuesday that it had abandoned its plan to appeal to the Constitutional Council to overturn the law amending Articles L.29 and L.30 of the Electoral Code. This reform, adopted on April 28 by the National Assembly at the initiative of the Pastef-Les Patriotes group (the majority), had nevertheless provoked a strong backlash from the opposition, which initially considered suspending its implementation through legal means.

This decision not to pursue legal action continues to elicit mixed reactions in the political sphere. For legal scholar Moustapha Sy, president of the Défé Néneen ("Act Differently") movement, this decision deprives the opposition of a key institutional tool. According to him, a legal challenge is not solely about contesting the constitutionality of a text; it primarily serves to "enrich the legal and democratic debate surrounding the adopted provisions."

The legal expert emphasizes that an intervention by the Constitutional Council goes beyond a purely political objective: "It helps to clarify the interpretation of norms, to build constitutional case law, to strengthen legal certainty, and to provide lasting clarity to citizens and political actors on the true scope of the reform."

Moustapha Sy points out that in a democracy, the role of the opposition cannot be limited to verbal criticism. Its purpose is to "mobilize all institutional control mechanisms in order to contribute to public debate and strengthen the rule of law."

By choosing judicial silence, the Takku Wallu coalition is, according to the president of Défé Néneen, signing a real "democratic loss" for Senegal.
