Talix Mines Affair: Ministry of Labor denounces "null dismissals" and demands reinstatement of delegates

Affaire Talix Mines : Le ministère du Travail dénonce des « licenciements nuls » et exige la réintégration des délégués

The dismissals of the 62 Talix Mines workers continue to generate much discussion. Questioned by MP Mbaye Dione last August, the Minister of Labor responded in September based on a detailed report from the Thiès Regional Inspectorate. According to the ministry, the document confirms multiple violations of the Labor Code and demands the immediate reinstatement of the dismissed union representatives.

 

In his letter of appeal, Mbaye Dione questioned "the validity of such dismissals" and "the regularity of the procedure." The MP also drew the government's attention to the legal obligations of consultation and job preservation before any decision to terminate employment.

 

The ministerial response addresses the concerns raised point by point. While the company cited economic difficulties, brandishing a debt of "2.465 billion FCFA in December 2024," the Inspectorate notes that "since the financial statements have not been certified by a certified public accountant, their reliability remains insufficient and does not, on its own, justify the layoffs."

 

But it is above all the procedure that is deemed irregular, with a lack of serious consultation with staff representatives, a failure to comply with alternative measures provided for by the Labor Code, and a violation of the order of dismissals. In addition, "despite the refusal decision of the Regional Inspectorate, the company proceeded to dismiss six union representatives," a decision that the ministry describes as "null and void."

 

In this regard, the Ministry of Labor, Employment and Relations with Institutions demands immediate corrective measures. The Labor Inspectorate has issued a formal notice against Talix Mines, demanding from the employer, among other things: the immediate reinstatement of the delegates concerned, with payment of wages owed since their dismissal, in accordance with Article L.217 of the Labor Code; the regularization of the rights of the dismissed workers, including the payment of statutory compensation (dismissal, notice, leave, special compensation).

 

In addition, there are the penalties incurred in the event of refusal of reinstatement. "The payment of twelve months' gross salary for those with between 1 and 5 years' seniority; twenty months for 5 to 10 years' seniority; and two months per year of presence with a maximum of thirty-six months for those with more than 10 years' seniority."

 

After an attempt at conciliation in May 2025 failed, the Inspectorate issued a report of non-conciliation on July 8, which was forwarded to the Thiès Labor Court. The case is now taking a judicial turn, beyond the standoff between the company and its employees.

 

The 62 workers, for their part, are still demanding their reinstatement and payment of their rights.

    Maintenant, il appartient au Tribunal du travail de trancher ce conflit. L'inspection du travail n'ayant pas réussi à concilier l'employeur et les travailleurs.

    Tout à fait, le Ministre ne saurait être le Juge du travail de dernier ressort. Ses proches collaborateurs auraient dû lui glisser un papier dans ce sens pour répondre au Député Dione.
